Since the Vegas interests own Harry Reid, it's not surprising.

In this case, though, it's obviously the right move.

Still curious that the democratian hasn't mentioned any of this. But upon review, is it really all that surprising?

Sen. Diane Feinstein (D-CA) gets the credit. Tribes are whining like cut cats, kinda like they did when they spent a fortune to kill I-892 here a while back.

Feinstein threatens to ‘stop reservation shopping once and for all’

WASHINGTON – After months of speculation about what exactly Sen. Dianne Feinstein had in mind for gaming legislation, the California Democrat finally showed her hand.

In an opinion piece in the Contra Costa Times Nov. 27, Feinstein presented a clear warning to her legislative colleagues: If the Senate takes up a “Carcieri fix” bill, she will bring forward legislation “to stop reservation shopping once and for all.”

Feinstein expressed concern about the expansion of Indian casinos on “off reservation” land in California. She cited a referendum in 2000 when voters authorized the governor to negotiate gambling pacts with federally recognized Indian tribes on Indian lands in California.

“But today the spirit of this proposition could be violated by major casinos proposed around the state on lands that are not ‘Indian lands’ – some of which are more than 100 miles from tribal headquarters,” she wrote.

To remedy the expansion of off reservation Indian casinos in California, Feinstein has promised to hold the “Carcieri fix” hostage.

“If the Senate takes up this (Carcieri) bill, I plan to offer legislation to make clear, once and for all, that reservation shopping is not acceptable in California,” Feinstein wrote.

The “Carcieri fix” is legislation proposed, which has passed both Senate and House committees, to repair a 2009 U.S. Supreme Court decision that interpreted the Indian Reorganization Act to mean the Interior secretary has no authority to take land into trust for tribes that were not “under federal jurisdiction” in 1934 when the IRA was passed. The ruling reversed 70 years of practice and has frozen trust applications at the Interior Department for the past two years.

“‘The ‘Carcieri fix’ would allow reservation shopping to continue,” Feinstein wrote.
