Yesterday's decision to allow terrorists free access to the United States is the kind of 9th Circuit decision that has resulted in that court being, by far, the most overturned court at the Supreme Court in recent memory.
This group of judicial idiots failed to even consider the primary basis for the Executive Order in question: 8 U.SC. §1182 (f)
It's easy for a court to rule in favor or opposition to a party in a case when they refuse to apply the law they are sworn to uphold.
The Constitution was written to avoid this very thing. The idea of lifetime appointments was to keep the judiciary separate from political considerations.
But what do you do when the judges place their political leaning ahead of the law to the point where they absolutely ignore it in the name of their agenda?
AT this point, the president should ignore the court and continue the ban as if they had never ruled. Meanwhile, Congress should meet and pass a law that clarifies the power of the president to do exactly what he has done.
There is absolutely nothing illegal or unconstitutional about this law: no alien has the "right" to be here, regardless of their status. That these judges allowed their politics and their agenda to overwhelm their judicial duty once again points to the number one weakness of our judicial system: the political agendas, right or left, of those holding these appointments.
These judges are guilty of legal malpractice. All of them should be charged with judicial misfeasance and they should all lose their law licenses.
Judges cannot pick and choose the laws they would enforce... even the laws they may not personally agree with.
Now is the time to act. And until those issues are resolved, it is in the president's best interests... and the country's best interests as well, to ignore these orders and implement the executive order as written.
Because NONE of these clowns will be the ones held accountable for the blood terrorists spill in this country.
The leftists will place that blame on President Trump. And by then, it will be too late.

(f) Suspension of entry or imposition of restrictions by President
Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline. This is black letter law, kids... an "inconvenient truth," if you will... and it would seem that neither that lying moron in Seattle nor the 3 fringe-leftist political judges on the 9th Circuit knows this law exists, since, even after arguments in both courts, neither apparently saw fit to address its existence.

ReplyDeleteSorry to disagree, but that is Obama style stuff.
He needs to rewrite the policy. Time after time until the courts get tired of it.
The law is straight forward. The Court's are choosing to ignore the law.
ReplyDeleteWhat Obama did was clearly violate the law. What the president is doing now clearly follows the law. Therefore, there is a critical difference between "Obama style" and "Trump style."
As a result, I respectfully disagree. We're not going to get any do-overs and none of these judges will ever be held accountable for their decisions when and if any of us get hurt as a result of those decisions. That will fall on the President alone and he will not be able to hide behind the actions of a few judges as his defense.
