Thoughts on the Clinton debacle.

It as been alleged, for the entirety of my life, that this... is a nation... of laws.

Many have indicated that such is a façade; a myth, a construct designed to keep the little people pacified under the concept of a faux equality.

Some claim it's based on money.  Others, race.  And still others, gender.

I believe, in the main, they're all wrong.

The number one rapist of equality in this country today is politics.

I watched FBI Director Comey yesterday.

He started his announcement by listing in detail most every provable instance where Clinton had broken the law.

He then added a section to the law that did not exist: intent.

This is the law that Clinton... and others... have violated:  18 U.S. Code § 793 - Gathering, transmitting or losing defense information

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—

Shall be fined under this title or imprisoned not more than ten years, or both.
I watched him detail the ways Clinton violated the law.  They were many and possibly disastrous.  Based on the words coming out of his mouth where he was detailing the ways she should be prosecuted, hope soared that he was a man of courage and conviction who was going to be doing the right thing and making the right recommendation.

But then, based on the fact that he couldn't verify that the emails had been accessed from that insecure private server AND that Clinton did not INTEND to break the law that she had done nothing worthy of prosecution... or that "no reasonable prosecutor would charge her."

On the contrary.  No reasonable prosecutor would do anything else.

The Director indicated that at best, Clinton was guilty of gross negligence.  he used the words "gross negligence" to describe, partially, what had happened.

He also used a word that's irrelevant "intent."

There is no "intent" requirement in this instance.  Essentially, if these things happened, "intent" is irrelevant.

The language is clear.  Quite clear.  Extraordinarily clear.  Her multiple violations?

Equally so.

HIS recommendation, then, SHOULD have been for prosecution.  If Justice or Obama or anyone else declined, that's on them.

And in failing to keep the FBI out of the corrupt politics of our government, he has removed from their pedestal and turned the perception of them into a corrupt group not unlike those portrayed on The Blacklist... just another partisan tool.

Nixon was risking impeachment for far less.

Service members from Petraeus on down through several other officers have been punished to include serious imprisonment using this section of the law for doing far, far, less.

Are they all now to have their sentences reviewed and their honor restored because of this?

After all, how can there possibly be such a double standard?

If Clinton's actions here, from the destruction of 33000 emails to the failure to follow US Government policies that SHE SIGNED OFF on... to the lying over and over and over again and everything else is not grounds for prosecution, then what is?

She's guilty of the acts in violation of 18 U.S. Code § 793 on multiple counts and she's committed perjury on a number of occasions, not to mention lying during her FBI "interview," the same thing that got Martha Stewart put away in prison.

But unlike us... she will not have to suffer the consequences.

Further, imagine this whack job as president?  She's already shown she can use these various government agencies to do what she wants.  Does this episode make that outcome MORE likely, or LESS likely?

What many of us have suspected about the law in this country is now confirmed.

Absolutely power corrupts absolutely.  Our current administration is the same as Putin.  No wonder they didn't give a crap about him invading the Ukraine.

"Equal Justice Under Law."

That is what it says on the front of the United States Supreme Court building.

What a fricking joke.
